                    Xpress Club & Resorts – Membership Terms & Conditions
                    
                        
                            - 
                                Membership Duration & Entitlement
                                
                                    - Membership is valid for 3 years from the date of activation.
 
                                    - Entitlement includes 5 Nights / 6 Days per year, totalling 15 nights over the membership period.
 
                                    - Accommodation is valid for 2 Adults + 2 Children below 6 years, or 3 Adults per room.
 
                                
                             
                            - 
                                Meal Plan
                                
                                    - Complimentary breakfast is included during each stay.
 
                                    - Lunch, dinner, and other services are chargeable unless specified in a promotional package.
 
                                
                             
                            - 
                                Room Category & Allocation
                                
                                    - Accommodation is provided in the base category room.
 
                                    - Room upgrades are available at an extra cost, subject to availability.
 
                                    - Each booking includes one room only.
 
                                    - Additional rooms can be arranged at discounted rates, subject to availability.
 
                                
                             
                            - 
                                Booking Policy
                                
                                    - All bookings must be made via email only.
 
                                    - Bookings should be made 15 to 60 days in advance.
 
                                    - A minimum 90-day gap is required between two bookings (from the check-out date).
 
                                    - 
                                        Bookings are:
                                        
                                            - On a first-come, first-served basis
 
                                            - Subject to availability and resort policies
 
                                            - Valid only at Xpress Club & Resorts affiliated/partnered properties
 
                                        
                                     
                                
                             
                            - 
                                Blackout Dates
                                
                                    - Last week of December to first week of January
 
                                    - National and regional festivals
 
                                    - Long weekends
 
                                    - Declared blackout dates (notified on the website)
 
                                
                             
                            - 
                                Complimentary Holidays
                                
                                    - Valid for 1 year only.
 
                                    - Cannot be clubbed with regular holiday entitlement.
 
                                    - Complimentary activities are subject to resort policies.
 
                                
                             
                            - 
                                Guest & Gifting Policy
                                
                                    - Membership is for personal use only.
 
                                    - Members may gift their holiday entitlement once per year with prior written intimation.
 
                                    - Guest bookings require prior approval and count against the member’s annual entitlement.
 
                                    - Additional guest/adult charges may apply as per property policy.
 
                                
                             
                            - 
                                Rescheduling & Rebooking Policy
                                
                                    - Rebooking is allowed up to 15 days before check-in.
 
                                    - No-show or late cancellation may lead to night deduction.
 
                                    - After one booking, the next booking can be made only after 90 days from the last checkout date.
 
                                
                             
                            - 
                                Advance Night Policy
                                
                                    - The company will not provide advance nights under any circumstances.
 
                                    - Holidays can only be availed after activation and eligibility confirmation.
 
                                
                             
                            - 
                                Annual Subscription Fee (ASF)
                                
                                    - ASF is waived for the 1st year.
 
                                    - From the 2nd year onwards, ASF will be ₹1,000 to ₹2,000 per night, depending on location, season, and property.
 
                                    - ASF must be fully paid before booking confirmation.
 
                                
                             
                            - 
                                Additional Services
                                
                                    - Services such as pickup/drop, sightseeing, meals (lunch/dinner), or extra rooms are available on request at additional charges.
 
                                
                             
                            - 
                                Sales Disclaimer
                                
                                    - No verbal, WhatsApp, or phone-based commitments are valid unless officially sent by company email.
 
                                    - The company is not responsible for unauthorized offers made by third-party sales agents.
 
                                
                             
                            - 
                                Payment Terms
                                
                                    - Holidays can be availed after at least 50% of the membership amount is paid.
 
                                    - This clause does not apply to customers who have opted for credit card EMI plans.
 
                                
                             
                            - 
                                Refund & Cancellation Policy (Including Post-Usage Cancellation)
                                
                                    - Membership is strictly non-refundable.
 
                                    - If services are not provided as per policy, resolution will be handled case-by-case.
 
                                    - In case of cancellation due to policy breach, a 10% cancellation fee will apply.
 
                                    - Any approved refund will be processed within 90 business days.
 
                                    - 
                                        If a member initiates cancellation after availing any holiday or making a booking, the company reserves the right to:
                                        
                                            - Deduct the cost of utilized bookings
 
                                            - Apply applicable cancellation charges from the total amount paid
 
                                        
                                     
                                    - The remaining balance (if any) will be calculated based on actual usage and refunded accordingly.
 
                                    - No refund shall be processed if the member has substantially availed the services.
 
                                
                             
                            - 
                                Transferability
                                
                                    - Membership is non-transferable unless approved in writing by Xpress Club & Resorts.
 
                                
                             
                            - 
                                Affiliated Properties
                                
                                    - Holidays are available at Xpress Club & Resorts affiliated/partner properties, including those under short or long-term tie-ups.
 
                                    - The valid property list is available on the official company website and is subject to change.
 
                                
                             
                            - 
                                Liability & Disclaimers
                                
                                    - The company is not liable for any injury, loss, or damage during the stay or travel.
 
                                    - All stays are subject to resort policies and local laws.
 
                                
                             
                            - 
                                Modification of Terms
                                
                                    - Xpress Club & Resorts reserves the right to modify terms and conditions at any time with prior notice via email or on the official website.
 
                                
                             
                            - 
                                Governing Law & Jurisdiction
                                
                                    - All disputes are governed under the laws of India.
 
                                    - Jurisdiction lies within the courts of the company’s registered office location.
 
                                
                             
                            - 
                                Misuse & Policy Violation
                                
                                    - If a member is found misusing membership benefits or violating company policy, the membership can be terminated immediately without any refund.
 
                                
                             
                            - 
                                No Guarantee of Specific Property or Date
                                
                                    - Bookings are strictly subject to availability. No member can demand specific dates, hotels, or room types.
 
                                
                             
                            - 
                                Limited Liability
                                
                                    - The company is not responsible for service failures caused by hotels, third-party vendors, natural calamities, or governmental restrictions.
 
                                
                             
                            - 
                                Non-Exchangeable Benefits
                                
                                    - All benefits such as bonus nights, complimentary stays, or vouchers are non-exchangeable and non-redeemable for cash or alternative services.
 
                                
                             
                            - 
                                Booking Denial Rights
                                
                                    - The company reserves the right to cancel or deny bookings in case of dues, policy violations, or misconduct, without refund or compensation.
 
                                
                             
                            - 
                                Changes to Partner Properties
                                
                                    - The company may modify its list of partner properties at any time. Members must choose from currently listed options only.
 
                                
                             
                            - 
                                Force Majeure Clause
                                
                                    - In cases of natural disasters, lockdowns, government bans, pandemics, strikes, etc., the company is not liable for any cancellation or disruption.
 
                                
                             
                            - 
                                Legally Binding Agreement
                                
                                    - Membership purchase confirms full acceptance of all terms and conditions, forming a legally binding agreement.
 
                                
                             
                            - 
                                No Verbal Commitments Valid
                                
                                    - Only written communication via official email is considered valid. Verbal or informal commitments have no legal value.
